Jury finds Denver cop guilty of felony kidnapping, sex assault

Denver cop Hector Paez grasped his forehead and quietly muttered "I don't understand" as he stared at the 12 men and women who who had just convicted him Tuesday evening of felony rape and kidnapping.

His wife, and the mother of their four children, collapsed into tears.

It had been more than two weeks of trial and more than two years since Paez was first accused of arresting a woman, driving her to a secluded spot in a deserted warehouse district and coercing her into oral sex.

The rape case — a test of credibility — put the dishonest cop up against an accuser with a checkered history that includes heroin abuse and a prostitution conviction.

Jurors deliberated for less than a day before reaching the verdict that will end Paez' career as a Denver police officer and could land him in prison for up to life. 

Chief Deputy District Attorney Doug Jackson said isn't always easy to fire errant officers, let alone convict them in criminal court.

"Jurors want to believe cops are good guys, and most are," Jackson said. "This is a good day for the Denver Police Department. There are a lot of good, hard working cops in that department, and now they can get rid of Officer Paez."

The 33-year-old Paez, who was cuffed and taken into custody, will remain in jail until a status hearing Thursday. At that point, District Court Judge John Madden will decide whether he can remain free on bond until he's sentenced.

The victim said Tuesday evening that she plans to ask Madden to keep Paez locked up, saying he threatened her during the May 16, 2010 assault and also stared her down as she testified.

The verdict was an emotional moment for her, too, she said.

"I was so overwhelmed. I just fell down to my knees, thanked God and I cried," she said. "I've been called a liar. This just justified everything."

Paez could face as little as probation for the felony charges. The rape carries a penalty of up to life in prison and the kidnapping up to 24 years in prison. He was also convicted of the misdemeanor charge of providing false information to authorities.

"We're both surprised and disappointed," said defense attorney Gary Lozow. "Hopefully an appeals court will get it right."

He argued during trial that Paez kept the woman in his car to gather intelligence on her heroin dealer and drove to an out-of-the-way spot so she wouldn't be spotted by her pimp.

The woman testified she was meeting her now fiance — not a pimp — at the lightrail station where she first encountered Paez.

Jurors filed out Tuesday without comment on what evidence they found most compelling.

Jackson and internal affairs Sgt. Jaime Lucero lined up GPS tracking data from Paez' patrol car, calls that the woman overheard on his car radio following the assault and accounts from other officers to piece together Paez' actions that day.

Paez' case was plagued by delays — the biggest coming in September 2011 when evidence misplaced by investigators surfaced and prompted a mistrial.

Throughout the life of the case, Paez' wife, brother and other family members have dutifully attended hearings.

But on Tuesday, some in tears, they declined to comment on the conviction as they filed out of the courtroom.

Denver woman accused of threatening middle school students with gun

A Denver mother who believed her daughter was being bullied at school drove into the school's parking lot and threatened four girls with a gun, according to an arrest document.

Monica Avila, 34, was charged Tuesday with four counts of felony menacing and one count of possession of a weapon on school grounds, also a felony. According to the probable cause statement accompanying her arrest paperwork, Avila drove into the parking lot at Lake Middle School on Thursday afternoon and confronted four girls, ages 13 and 14.

The statement says Avila began arguing with the girls about bullying. She then, while still sitting in her car, pulled out a black semi-automatic handgun and said, "Look what I have," the document states.

Avila then drove out of the parking lot and parked across the street, as the girls told adults about what happened and called 911, according to the probable cause statement.

When officers arrived, they found Avila sitting in her car. They later found a handgun in the car.

Avila is being held in the Denver County Jail on a $50,000 bond. She is scheduled to appear in court again on Thursday to be formally advised of the charges against her, according to the Denver District Attorney's Office.

Probe continues in Wal-Mart bribery case, may face sizeable fines

In April the newspaper reported that Wal-Mart had stifled an internal probe into bribery at its Mexican affiliate Walmex, but gave the impression that many of the bribes paid may have been used to facilitate approval processes already in motion.

“I think the Times story, if it is true, changes the perception of the Wal-Mart matter from being about facilitating payments to something larger than that,” said Danforth Newcomb, an expert on US Foreign Corrupt Practices Act (FCPA) who defends such cases at the law firm Shearman & Sterling.

The latest story describes, for example, $765,000 in bribes that helped Wal-Mart build a refrigerated distribution center in an environmentally fragile area where electricity was scarce and smaller developers were turned away. It also describes in detail how Wal-Mart allegedly paid $52,000 to change a zoning map so it could open a store near the ancient pyramids in Teotihuacan.

It is difficult to put a ballpark figure on any settlement, especially because the US investigation into Wal-Mart is in early stages, but experts said it could rival other major FCPA cases.

In the largest FCPA case to date, Siemens paid $800 million to resolve allegations of widespread bribery in 2008. In other sizeable cases, KBR and its former parent Halliburton paid $579 million in 2009, and BAE Systems paid $400 million in 2010.

Wal-Mart declined to provide additional comment on Tuesday. On Monday, Wal-Mart said that the allegations in the Times report have been part of the investigation of potential FCPA violations the company began conducting more than a year ago.

The company is cooperating with the US Justice Department and the U.S. Securities and Exchange Commission on the matter.

Representatives of the SEC and DOJ declined to comment.

POTENTIAL FINES

The Justice Department usually calculates fines in foreign bribery cases by either levying a per-violation fine or a penalty tied to the profits a company earned through the alleged bribery. Related SEC settlements usually also involve disgorging profits earned due to the bribery. Including Walmex’s profits at stores throughout Mexico could prove a sizable fine. It is unclear how many of the roughly 2,000 locations in Mexico could be included. In 2011, Walmex posted gross profit of nearly 83.7 billion pesos.

In 2004, the year in which it allegedly pushed for zoning to open the store near the ancient pyramids, Walmex’s gross profit was 28.84 billion pesos. The 2011 results include Central America.

When calculating potential fines, prosecutors take into account how widespread the conduct was, and whether senior management knew about it or were involved in any way. Wal-Mart has said it is investigating allegations related to its operations in Brazil, India, and China.

“Wal-Mart de Mexico didn’t stumble into a bit of bribery. If the allegations are correct, it used systematic bribery as part of its business strategy as a way to grow,” said Richard Cassin, an FCPA expert and author of a popular FCPA blog.

The company’s costs to conduct the entire investigation – which already stand at $100 million – could be larger than its eventual fines, lawyers said.

Wal-Mart has also been proactive with other measures that could blunt some of the demands from authorities. When settling FCPA cases, companies are usually required to make some management changes and overhaul their compliance programs.

In October the company said it reorganized its compliance department and created a new global chief compliance officer position as part of an overhaul of its anti-corruption efforts.

It said then that it spent more than $30 million to update its anti-corruption program, named a new chief compliance officer for Wal-Mart International and a new vice president of global investigations, which are both new positions for the company. It also previously created a new global FCPA compliance officer position.

The plan should have details as to whether Kingfisher Airlines has adequate working capital, whether it has enough funds to settle employees’ dues, whether its aircraft is airworthy and are pilots’ medical requirements fulfilled, the ET report said quoting the DGCA.

According to the report, the new conditions have been set as Kingfisher’s aircraft have been grounded for more than two months. As per the rules, if pilots do not fly for a month, their licence gets redundant, the report said.

Kingfisher Chairman Vijay Mallya, who has proposed to start limited operations by pumping in Rs 425 crore, has very little time left to fulfill all these requirements. It looks almost impossible for him to set all these right before 31 December.

DGCA Arun Mishra had told Firstpost earlier the airline is yet to come back with the revival plan.

The article had said that there are many hurdles to the revival of the airline.

It is also unlikely that competitors will take kindly to his plans to fly again, especially at a time when passenger loads and yields (revenue per passenger) are falling despite this being the peak holiday season.

Not only competitors’ manoeuvres, Mallya has a lot else to worry about too: He needs to ensure at least some dues to vendors are cleared.

Otherwise, how will the airline get continued fuel supplies, operate from some key airports where dues have mounted or even stop lessors from seizing aircraft?

There are tough conditions set. But at the same time, there are relaxations too.

Looking for a answer backed up with (API) rules as well as experiences for the following:

We will be using the following stacks:
29-1/2" 500 PSI
21-1/4" 2K
13-5/8" 10K

The last two stacks will have drilling spools installed, both with 4-1/16" outlets

The 21-1/4" spool has 4-1/16" 5K outlets
The 13-5/8" spool has 4-1/16" 10K outlets

The pressure control spools will be connected to these outlets. We have both 5K and 10K sets. Also we have the crossover DSA to connect the 10K valves to the 5K outlets of the 21-1/4" spool.

Now the question:

Can we use 10K valves connected to the 21-1/4" stack with a DSA 4-1/16" 5K x 10K?

I have heard several reasons why not to do it as well as reasons to do it and why it would not be a unsafer situation.

I appreciate your comments and experiences.
